1/ Negotiated Rate Term. The Negotiated Rate Term shall commence on the date Segment 17 Expansion capacity to provide this service is available ("Effective Date"),

which is anticipated to be January 1, 2007. The Negotiated Rate Term shall end ten (10) years from the Effective Date.
