The payment of the reservation charge by the Replacement
Shipper on a one-part volumetric basis shall not relieve
KPC, the releasing Shipper or the Replacement Shipper from
their obligations to conform to all of the terms and
conditions of this Section 14.
(c) When a Releasing Shipper assigns Transportation service
rights under any Rate Schedule, the MAIQ under the
Transportation Agreement will be reduced proportionately by
the amount of MDCQ assigned. Any imbalance in excess of
this reduced MAIQ must be reduced to the new tolerance level
in the month following the completion of the assignment to
avoid balancing charges pursuant to Section 12.11.
(d) When a Releasing Shipper assigns its service rights under a
FT or FT-NN Agreement, by assigning service rights by
segment, and/or by assigning only a portion of the MDCQ
under that Agreement, the Releasing Shipper's Service
Agreement shall be deemed to be modified in accordance with
the assignment and the Releasing Shipper will be able to
utilize only the unassigned service rights during the term
of the assignment.
(e) If the Releasing Shipper's Service Agreement has been
assigned to a Designated Replacement Shipper for a period
of not more than thirty-one (31) Days, the Releasing Shipper
may not assign the Service Agreement to the same Replacement
Shipper for a term of not more than Thirty-one (31) Days
until twenty-eight (28) Days after the termination of the
assignment unless the Service Agreement is posted on the EBB
System for bidding in accordance with this Section 14 or the
Replacement Shipper has agreed to pay the posted maximum
rate, or higher, for the service, is on the approved bidders
list and all the other conditions applicable to the
assignment.
(f) If the Releasing Shipper's Service Agreement is assigned
permanently for the remaining term of the agreement, subject
to KPC's agreement, the Releasing Shipper shall have no
further responsibility or obligations under the Service
Agreement.
