GENERAL TERMS AND CONDITIONS (Continued)
6.14 For Capacity Release:
Transporter shall not award capacity release offers to the
Replacement Shipper until and unless the Replacement Shipper meets
the Transporter's creditworthiness requirements pursuant to
Sections 6.1, 6.2 and 6.3 of these General Terms and Conditions,
which are applicable to all services that it receives from the
Transporter, including the service represented by the capacity
release.
6.15 Transporter should provide the original Releasing Shipper with
Internet E-mail notification reasonably proximate in time with any
of the following formal notices given by the Transporter to the
Releasing Shipper's Replacement Shipper(s), of the following:
(1) Notice to the Replacement Shipper regarding the Replacement
Shipper's past due, deficiency or default status pursuant to
the Transporter's Tariff;
(2) Notice to the Replacement Shipper regarding the Replacement
Shipper's suspension of service notice;
(3) Notice to the Replacement Shipper regarding the Replacement
Shipper's contract termination notice due to default or
credit-related issues; and
(4) Notice to the Replacement Shipper that the Replacement
Shipper(s) is no longer creditworthy and has not provided
credit alternatives(s) pursuant to the Transporter's Tariff.
7. CONTRACTING FOR SERVICE RIGHTS
This Section 7 governs the order in which requests for Transportation
service rights shall be accommodated where capacity is not available for
all valid requests. It does not govern scheduling, which is governed by
Section 8 herein.
