FIRM TRANSPORTATION, NO NOTICE SERVICE
hereunder, Shipper shall be subject to an overrun charge in
addition to the applicable reservation charge and any
balancing charges that may be applicable pursuant to Section
12 of the General Terms and Conditions. Subject to the
provisions of Section 3.3(b) of this Rate Schedule, the
applicable charge per Dt. for such overrun quantities shall
be as set forth on the effective Tariff Sheet Nos. 37 and
38.
(b) Takes in Excess of Permissible Hourly Deliveries
If, pursuant to Section 5 hereof, Shipper has been notified
that it must limit hourly takes of the Quantities nominated
for delivery at the Point(s) of Delivery, Shipper must use
its best efforts to limit its takes of the Quantities
nominated for delivery at the Point(s) of Delivery as soon
as possible, but in no event later than two hours following
notification. If, after such two hours, the Shipper's takes
exceed such hourly limitation for any hour during the next
twenty-four hour period, Shipper shall pay the overrun
charges as set forth on the effective Tariff Sheet Nos. 37
and 38, in addition to any other applicable charges.
(c) Overrun Charge for Takes During Operational Flow Orders and
Extreme Conditions
When Gas throughput approaches capacity on any portion of
KPC's system, KPC may issue an Operational Flow Order (OFO)
or declare an extreme conditions situation as to that
portion of the System by notifying Shippers through the IEC
System and telephone or facsimile communication. Once
declared this situation shall continue until KPC notifies
Shippers to the contrary. During an extreme conditions
situation the applicable charge per Dt. for overrun
quantities in excess of the MDCQ shall be those as defined
in Section 12.13 of this General Terms and Conditions.
