22.8 ELECTRONIC FLOW COMPUTERS
It is recognized that electronic or other types of flow
computers have been developed that permit the direct computation of gas
flows without the use of charts. Where the substitution of these devices
is deemed acceptable by Trailblazer in the exercise of its reasonable
judgment, their use for custody transfer will be permitted.
22.9 NEW MEASUREMENT TECHNIQUES
If, at any time, a new method or technique is developed with
respect to gas measurement or the determination of the factors used in
such gas measurement, such new method or technique may be substituted by
Trailblazer in exercise of its reasonable judgment. Trailblazer shall
promptly inform all Shippers of any new techniques adopted.
22.10 CALIBRATION AND TEST OF METERS
The accuracy of all measuring equipment shall be verified by
Trailblazer at reasonable intervals, and if requested, in the presence
of representatives of Shipper, but neither Shipper nor Trailblazer shall
be required to verify the accuracy of such equipment more frequently
than once in any thirty (30) day period. If either party at any time
desires a special test of any measuring equipment, it will promptly
notify the other, and the parties shall then cooperate to secure a
prompt verification of the accuracy of such equipment.
22.11 CORRECTION OF METERING ERRORS
If, upon any test, any measuring equipment is found to be
inaccurate, such equipment shall be adjusted immediately to measure
accurately. If, upon any test, the measuring equipment in the aggregate
is found to be inaccurate by one percent (1%) or more at a recording
corresponding to the average hourly rate of gas flow for the period
since the last preceding test, any payments based thereon shall be
corrected pursuant to Section 16.5 hereof, at the rate of such
inaccuracy for any period which is known definitely or agreed upon, but
in case the period is not known definitely or agreed upon, such
correction shall be for a period extending over one-half (1/2) of the
time elapsed since the date of the last test. Measurement data
corrections should be processed within six (6) months of the production
month with a three (3) month rebuttal period. This standard shall not
apply in the case of deliberate omission or misrepresentation or mutual
mistake of fact. Parties' other statutory or contractual rights shall
not otherwise be diminished by this standard.
