ADDITIONAL FOOTNOTES APPLICABLE TO SHEET NO. 7

3/ Eligible Transportation Quantity. The Negotiated Rates shall apply only to all quantities transported under the FTS Agreement from the Eligible Receipt

Points set forth in Footnote No. 5 below to the Eligible Delivery Points set forth in Footnote No. 6 below, up to a total aggregate maximum daily

transportation quantity shown above and any associated capacity release replacement agreements.

 

Authorized Overrun Service. Unless Trailblazer otherwise expressly agrees in writing, Authorized Overrun Service provided to Shipper under the FTS Agreement

shall be billed and paid at the Negotiated Rates. The commodity charge, ACA, and Fuel Gas and Lost and Unaccounted For will be assessed in addition to the

Negotiated Reservation Rate. The Negotiated Reservation Rate shall include any additional authorized surcharges.

 

Fuel Gas and Gas Lost and Unaccounted For. In addition to the Negotiated Rates, Shipper shall be charged for or provide in kind Fuel Gas and Gas Lost and

Unaccounted For in accordance with the applicable provisions of Trailblazer's FERC Gas Tariff, as may be revised from time to time; provided that during the

Negotiated Rate Term, Fuel Gas shall not exceed 3.2% of quantities tendered for transportation under the FTS Agreement.

 

Applicable Maximum Rates, Charges and Surcharges. Unless otherwise expressly provided herein, all applicable maximum rates, charges, surcharges, and

penalties of any nature set forth in Trailblazer's FERC Gas Tariff shall apply to service provided to Shipper under the FTS Agreement.

 

4/ Negotiated Reservation Rate is $7.2611/Dth of MDQ beginning and commencing the eleventh (11) year following the effective date.

 

5/ Eligible Receipt Points. The Negotiated Rates shall only apply to transportation service provided from the following receipt points.

 

Primary Receipt Points: WIC/TPC Dull Knife Weld, PIN No. 5001.

Secondary Receipt Points: All secondary receipt points permitted under the FTS Agreement pursuant to the General Terms and Conditions of Trailblazer's FERC

Gas Tariff, as may be revised from time to time.

 

6/ Eligible Delivery Points. The Negotiated Rates shall only apply to transportation service provided to the following delivery points.

 

Primary Delivery Points: NNG/TPC Gage, PIN No. 902901, for CMS Energy Marketing, Services and Trading Company, NGPL/TPC Gage, PIN No. 902900, for all others

listed above.

Secondary Delivery Points: All secondary delivery points permitted under the FTS Agreement pursuant to the General Terms and Conditions of Trailblazer's

FERC Gas Tariff, as may be revised from time to time.

 

7/ Effective June 1, 2002, CMS Energy Marketing, Services and Trading Company has permanently released their capacity to Marathon Oil Company.

 

8/ The information is set out in the executed Transportation Rate Schedule FTS Agreement and corresponding Negotiated Rate Exhibit, which are currently on file

with the FERC.
