18. A Shipper may release any or all of its firm capacity to a designated
potential shipper pursuant to a prearranged agreement between such Shipper and
potential shipper without complying with the notification and bidding
requirements of this Article XXXIII when the release meets the following
requirements:
a) the release of capacity is to an asset manager as defined in
18 C.F.R.§ 284.8(h)(3);
b) the release of capacity is to a marketer participating in a
state-regulated retail access program as defined in 18 C.F.R.
§ 284.8(h)(4); or
c) the release of capacity is for more than one year at the
applicable maximum rate for the applicable firm transportation
service being released.
Notice of the prearranged releases that qualify under this Section must be
posted by the Shipper on the IPP as soon as possible, but not later than
the first nomination, after the release transaction commences. This
posting shall conform to NAESB Standards. In addition, for releases to an
asset manager the posting should include the volumetric level of the asset
manager's delivery or purchase obligation and the time periods during
which that obligation is in effect. The posting should also include
whether the release is to a marketer participating in a state-regulated
retail access program.
Transporter adopts the following NAESB Data Dictionary Standards relating to
capacity release: 5.4.1 through 5.4.22.
