9. WAIVERS

Canyon may waive any rights hereunder or any obligations

of Shipper on a basis which is not unduly discriminatory; provided

that no waiver shall operate or be construed as a waiver of other or

future rights or obligations, whether of a like or different

character.

10. GENERAL TERMS AND CONDITIONS

The provisions of the General Terms and Conditions of

this Tariff, as such provisions may be amended from time to time,

are hereby incorporated by reference and made a part of this Rate

Schedule FCS and shall apply to service rendered hereunder as though

stated herein.
