8.2 Shipper warrants for itself, its successors and assigns that any
Natural Gas delivered to Transporter shall meet each of the
quality standards set forth in Section 4 of these General Terms
and Conditions. Shipper further warrants that it will indemnify
Transporter and save it harmless from all suits, actions, debts,
accounts, damages, costs, losses, and expenses arising from or out
of any claims, demands, costs, expenses, penalties, or fines in
any manner directly or indirectly connected with or growing out of
Shipper's delivery to Transporter of any gas that fails to meet
each of the quality standards set forth in Section 4 of these
General Terms and Conditions.
8.3 From the time Natural Gas is received by Transporter at the
Point(s) of Receipt, Transporter shall have the unqualified right
to commingle such Natural Gas with other Natural Gas in
Transporter's pipeline system.
9. WAIVER
Transporter may waive any of its rights hereunder or any obligations of
Shipper hereunder as to any specific default that has already occurred
or in advance as to any specific temporary issue, on a case-by-case or
generic basis and in a not unduly discriminatory manner; provided that
no waiver shall operate or be construed as a waiver of other or future
rights or obligations, whether of a like or different character. No
waiver by either Transporter or Shipper of any one or more defaults by
the other in the performance of any provision of a Service Agreement
shall operate or be construed as a waiver of any future default or
defaults, whether of a like or of a different character.
