9.13 Recalls and Reputs of Capacity. If capacity is released subject to
recall pursuant to Section 9.7(c), in addition to such other terms
not inconsistent with this Section as are agreed to by the Releasing
Shipper and the Replacement Shipper, recall of such capacity shall
be subject to the following terms and conditions:
(a) All Transportation Service Providers ("TSPs") should support
the following recall notification periods for all released
capacity subject to recall rights: (NAESB WGQ Standard 5.3.44)
(1) Timely Recall Notification:
(i) A Releasing Shipper recalling capacity should provide
notice of such recall to the TSP and the first
Replacement Shipper no later than 8:00 a.m. on the day
that Timely Nominations are due;
(ii) The TSP should provide notification of such recall to
all affected Replacement Shippers no later than 9:00
a.m. on the day that Timely Nominations are due
(Central Clock Time);
(2) Early Evening Recall Notification:
(i) A Releasing Shipper recalling capacity should provide
notice of such recall to the TSP and the first
Replacement Shipper no later than 3:00 p.m. on the day
that Evening Nominations are due;
(ii) The TSP should provide notification of such recall to
all affected Replacement Shippers no later than 4:00
p.m. on the day that Evening Nominations are due
(Central Clock Time);
(3) Evening Recall Notification:
(i) A Releasing Shipper recalling capacity should provide
notice of such recall to the TSP and the first
Replacement Shipper no later than 5:00 p.m. on the day
that Evening Nominations are due;
(ii) The TSP should provide notification of such recall to
all affected Replacement Shippers no later than 6:00
p.m. on the day that Evening Nominations are due
(Central Clock Time);
