binding order of any court or governmental authority, and
any other cause, whether of the kind herein enumerated or
otherwise, not within the control of the one claiming
suspension and which by the exercise of due diligence it is
unable to prevent or overcome. Failure to prevent or
settle any strike or strikes shall not be considered a
matter within the control of the party claiming suspension.
14.2 Such causes or contingencies affecting performance shall
not relieve Western or Buyer or Shipper of liability in the
event of failure of either to use due diligence to remedy
the situation and to remove the cause in an adequate manner
and with all reasonable dispatch, nor shall such causes and
contingencies relieve either from its obligation to make
payments of amounts then due hereunder.
15. PRIORITY OF SERVICE, CAPACITY ALLOCATION AND CURTAILMENT:
15.1 Right of Western to Serve Others - Nothing in these General
Terms and Conditions, this FERC Gas Tariff, any Rate
Schedule, or any Service Agreement executed by Western and
Buyer or Shipper shall in any way abridge the right of
Western to sell, receive, transport or deliver natural gas
to or for others. In providing service to others, Western
shall not unreasonably discriminate against existing or
future Buyers or Shippers.
15.2 General - It is recognized that Western's capacity may be
limited on a system-wide basis or on a segment-by-segment
basis. The allocation procedures and priorities set forth
in this Section 15 shall apply to both system-wide and
segment-by-segment limitations or curtailments, insofar as
is possible.
15.3 Notice of Curtailment - Western shall give Buyer or Shipper
a minimum of two hours notice of curtailment except in the
case of an emergency. In case of emergency, Western shall
give Buyer or Shipper such notice as circumstances permit.
