applicable since it was not part of the negotiated agreement. Any volume gathered at this point would be subject to

the rate of $.1055/dth. The delivery point is also omitted since this is also an unknown and non-applicable item

that was not part of the negotiated rate agreement. Determination of delivery points is subject to the entitlements

of the shipper who moves the gas away from the Tooke #21 Well, and does not effect Texaco's gathering rate.

The above Negotiated Rate Contract(s) do not deviate in any material aspect from the form of service agreement

in the tariff.
