FIRM ALTERNATE VAPORIZATION

3.4 Overrun Charge

The monthly Overrun Charge shall be the product of the

actual Quantity of LNG regasified in excess of Shipper's

MDQ for each Day and the overrun rate per Dt for service,

as set forth on the effective Tariff Sheet No. 5.

3.5 Fuel Reimbursement

Fuel reimbursement is inapplicable to volumes of

Regasified LNG delivered under this Rate Schedule FAV.

3.6 Range of Rates

Unless otherwise agreed to in writing between Shipper and

TLNG, any rate applicable to Shipper for service hereunder

shall be the applicable Maximum Rate set forth on the

effective Tariff Sheet No. 5, plus any other charges

specified in the General Terms and Conditions, as may be

applicable from time to time. If an amount less than the

applicable Maximum Rate and not less than the applicable

Minimum Rate is agreed upon, such amount shall be applied

prospectively. TLNG shall be responsible for compliance

with any reporting requirements prescribed by the

Commission. TLNG shall not be required to enter into any

Service Agreement for Alternate Vaporization at a rate

less than the Maximum Rate per Dt.

3.7 Negotiated Rates

Shipper and TLNG may agree, on a prospective basis, to a

Negotiated Rate with respect to the charges identified in

Sections 3.1 and 3.2 herein. Such Negotiated Rate shall

be set forth on Exhibit A of the executed Service

Agreement and on the currently effective Tariff Sheet

No. 6. The Maximum Rate shall be available to any Shipper

that does not choose a Negotiated Rate.
