FIRM ALTERNATE VAPORIZATION

2.3 TLNG shall manage Shipper’s Alternate Vaporization Service

by utilizing ambient air vaporization to regasify LNG for

delivery. TLNG shall not be obligated to provide

Alternate Vaporization Service when operating conditions

dictate that ambient air vaporization would be imprudent

or would not be consistent with efficient operation of

TLNG’s facilities.

2.4 In the event of capacity release pursuant to Section 9 of

the General Terms and Conditions, capacity under a Rate

Schedule FAV Service Agreement may only be released along

with the release of corresponding capacity under Shipper’s

Rate Schedule FTS or FTS-2 Service Agreement. A right of

first refusal may be exercised under Section 11 of the

General Terms and Conditions with respect to capacity

under a Rate Schedule FAV Service Agreement only to the

extent that Shipper has capacity under a Rate Schedule FTS

or FTS-2 Service Agreement.

2.5 In no event shall TLNG be obligated to provide any

Alternate Vaporization Service which would require the

construction or acquisition of new facilities or the

modification or expansion of existing facilities.

3. RATES

The rates and charges for firm service under this Rate Schedule

FAV shall be as follows:

3.1 Reservation Charge

The monthly Reservation Charge shall be the product of

Shipper's MDQ and the reservation rate per Dt for service,

as set forth on the effective Tariff Sheet No. 5.

3.2 Usage Charge

The monthly Usage Charge shall be the product of the

actual Quantity of LNG regasified during the Month and the

usage rate per Dt for service, as set forth on the

effective Tariff Sheet No. 5.

3.3 Surcharges

No surcharges shall be applicable to service under this

Rate Schedule FAV.
