In no event (except in the case of intentional misconduct or gross negligence by Transporter) shall

Transporter be liable to Shipper for any consequential, special, or punitive damages based upon the liability

of Transporter for breach of this agreement or upon any liability under any other legal theory based on any

breach or alleged breach of any obligation created under this agreement. Such excluded damages include, but

are not limited to, lost profits.
