Changes to the above addresses shall be effectuated by a Party notifying the other Party in

writing of the modification.

21. A waiver by either Party of any one or more defaults by the other Party hereunder shall not

operate as a waiver of any future default or defaults, whether of like or different

character.

22. Other Provisions:________________________________________________________

The Parties agree that facsimile copies, when properly executed and transmitted, shall be

considered for all purposes to be an original contract, and shall be deemed for all purposes

to be binding agreements. To submit an OBA via fax, the entire OBA must be faxed to

Transporter's Commercial Group at (281) 714-2179. The OBA must also be properly executed.

Upon Operator's request, Transporter will also furnish Operator with a paper copy of the

executed OBA.

IN WITNESS WHEREOF, the Parties hereto have executed duplicate originals of this Agreement on

the date set forth hereinabove.
