37. CASH OUT PROVISIONS (Continued)

37.2 (a) The monthly cash out penalty provisions set forth in Section 37.1(c)-(h) shall

not apply to the extent that an imbalance is caused by events of force majeure,

as defined in Section 11 of the General Terms and Conditions.

(b) Seller shall refund cash out revenues received in excess of costs incurred in

accordance with the provisions of Section 15 of the General Terms and

Conditions.
