STATEMENT OF NEGOTIATED RATES

Rate Schedule: FT
Time Period(s): Beginning on the effective date of Contract No. 27434 and continuing for 10 years from the date that the
Contract Demand in this Agreement increases to 300,000 MMBtu per day.
Quantity(ies): 55,000 MMBtu per day beginning the later of (a) April 1, 2009, or (b) the first day of the month after the
date Texas Gas installs and places into service on the Fayetteville Expansion Project a 36-inch line
underneath the Little Red River.
100,000 MMBtu per day beginning April 1, 2010, unless Texas Gas has: i) received approval from the
Pipeline and Hazardous Materials Safety Administration of Texas Gas' Special Operating Permit
applications, and (ii) received authority from the Federal Energy Regulatory Commission to operate the
Fayetteville Lateral at capacity of 950,000 MMBtu per day, in which case the contract Demand shall be
150,000 MMBtu per day.
200,000 MMBtu per day beginning April 1, 2011, unless Texas Gas has: i) received approval from the
Pipeline and Hazardous Materials Safety Administration of Texas Gas' Special Operating Permit
applications, and (ii) received authority from the Federal Energy Regulatory Commission to operate the
Fayetteville Lateral at capacity of 950,000 MMBtu per day, in which case the Contract Demand shall be
250,000 MMBtu per day.
300,000 MMBtu per day beginning April 1, 2012
Provided, however, the Contract Demand Schedule above shall be superseded and the Contract Demand shall be
300,000 MMBtu/day the later of (a) April 1, 2010, or (b) the first day of the month after the date Texas
Gas has: i) received approval from the Pipeline and Hazardous Materials Safety Administration of Texas
Gas' Special Operating Permit applications, and (ii) completed installation of compression facilities at
Texas Gas' Bald Knob station.
