(2) Notwithstanding the foregoing, Transporter and the

Shipper may negotiate an alternative cost recovery mechanism.

(3) If Transporter is unable to fully collect all costs

associated with the facilities from the Shipper, Transporter will not

seek to recover such costs from other Shippers in future rate

proceedings.

27.3 Agreement. In each case where Transporter, and Columbia, agreed to

construct facilities at the request of the Shipper, unless otherwise

agreed, the Service Agreement will contain as an Exhibit thereto an

agreement concerning such facilities, executed in the form as set forth in

this Tariff.
