9.7 The term "Storage Contract Year" shall mean the period from April 1

of the calendar year through March 31 of the following calendar year.

9.8 The term "Permanent Capacity Release" - shall mean the release of

capacity by the Customer for the remaining term of its Agreement with Seller

at the rates(s) Customer is obligated to pay for the capacity to be

permanently released. Releasing Customer shall not be liable for any charges

incurred by the Replacement Customer after the Permanent Capacity Release.

However, Seller may refuse to allow a Permanent Capacity Release if Seller

has a reasonable basis to conclude that it will not be financially

indifferent to the release. If Customer’s request to permanently release

capacity is denied by Seller, Seller shall notify Customer and include in

the notification the reasons for such denial. Replacement Customer shall be

subject to all terms of this Tariff.
