4.5 Retention of Records:
All original records of measurement or test data compiled by
either party in conjunction with the provisions of Transporter's
Rate Schedules and these General Terms and Conditions shall be
preserved by the party for a minimum period of three (3) years
from the date the record was made.
4.6 Prior Period Adjustments:
The deadline for closing of measurement data shall be no later
than 5 Business Days after the month of flow. Missing or late
measurement data shall be estimated by the measuring party. Any
measurement data or corrections received by Transporter after it
has closed the previous month of flow shall be handled as a prior
period adjustment. Transporter shall process late measurement
data or corrections of measurement errors as soon as practicable.
However, for Transportation Service Agreements executed after June
1, 1997, Transporter shall process late measurement data or
corrections of measurement errors as soon as practicable but no
later than six months after the applicable month of flow in
question with a three month rebuttal period. These deadlines do
not apply in the case of deliberate omission or misrepresentation
by a party (or its representative) or mutual mistake of fact. The
parties other statutory or contractual rights shall not be
diminished by this provision. The correction shall be made to the
month of flow with a restated line item and a new total quantity
of gas for the specific day(s) and the respective month.
