e) Waiver of Penalties

To the extent that a Shipper is bumped as a result

of an Intraday nomination by a Shipper with a

higher priority of service, Sabine will waive any

applicable penalties incurred by Shipper solely as

a result of the Intraday bump, and only for the

Day on which Shipper is bumped.
