CAPACITY RELEASE TRANSACTIONS (Continued)

ARTICLE III - AUTHORITY FOR TRANSPORTATION OR STORAGE SERVICE

To be specified in the applicable Award Notice, if other than storage or transportation

pursuant to Part 284, Subpart G of the Commission's regulations.

ARTICLE IV - RATE SCHEDULE

To be specified in the applicable Award Notice.

Replacement Customer agrees that Petal shall have the unilateral right to file with the

appropriate regulatory authority and make changes effective as to (a) the rates and

charges applicable to service pursuant to this Master Service Agreement for Capacity

Release Transactions, (b) the terms and conditions of this Master Service Agreement for

Capacity Release Transactions , pursuant to which service hereunder is rendered or (c)

any provision of the General Terms and Conditions applicable to this Master Service

Agreement for Capacity Release Transactions. Petal agrees that Replacement Customer

may protest or contest the aforementioned filings, and the Replacement Customer does not

waive any rights it may have with respect to such filings.

ARTICLE V - TERM OF AGREEMENT

The term of any release transaction under this Agreement shall be specified in Petal's

Award Notice. If Petal determines at any time that replacement Customer fails to meet

the financial standards or credit criteria of Section 3 of the General Terms and

Conditions, Petal may terminate this Master Service Agreement for Capacity Release

Transactions and reject all bids prospectively in accordance with Section 4 of Petal's

FSS, FSS-1 or FTS Rate Schedule, as the case may be.

ARTICLE VI - RATES

The storage capacity, deliverability, injection, and withdrawal rates or the

transportation reservation and usage rates applicable to Customer for service

provided to and from primary receipt and primary delivery points and secondary receipt

and delivery points under this Agreement shall be as stated in Petal's Award Notice.

Unless Petal shall agree otherwise, the reservation and usage rates applicable to

Customer for transportation service provided to or from a secondary receipt or delivery

point not identified in Petal's capacity release award shall be at the maximum rates

provided under the FTS Rate Schedule.
