(a) A notice electing to exercise the right of first refusal
under Section 7 of these General Terms and Conditions shall
be in writing and sent by ordinary mail. Other
communications regarding the right of first refusal shall be
by facsimile. The posting for bidding shall be on
Transporter's Internet web site.
(b) Operational Flow Orders shall be communicated as provided in
Section 8.3 of these General Terms and Conditions.
(c) Nominations and all communications related to scheduling and
curtailment shall be via facsimile or by electronic means
acceptable to both parties.
(d) Communications regarding invoicing and payment shall be
consistent with Section 10 of these General Terms and
Conditions.
(e) The current Retainage percentage and any change in such
percentage shall be communicated via posting on
Transporter's web site.
(f) Requests for service must be submitted in a form and manner
consistent with Section 5.
(g) Capacity release offers and bids must be communicated in
accordance with the procedures set forth in Section 11.
17. MODIFICATION
No modification of the terms and provisions of an executed
transportation service agreement shall be made except by the execution
of a superseding transportation service agreement or the execution of a
superseding exhibit to such agreement.
18. WAIVERS AND FUTURE DEFAULT
Transporter may waive any rights or any obligations of Shipper under any
transportation service agreement or this Tariff on a basis which is not
unduly discriminatory. No waiver by either Transporter or Shipper of
any one or more defaults by the other in the performance of any
provision of a transportation service agreement shall operate or be
construed as a waiver of any future default or defaults, whether of a
like or of a different character.
