35. CONTRACT EXTENSION AND RENEWAL (Continued)
35.3 Expiring capacity with a right-of-first-refusal will be made
available on a not unduly discriminatory basis and will be
assigned on the basis of an open season for a period of not
less than 20 business days' duration. Capacity that is sold
on an interim basis in accordance with Section 37, Capacity
Reserved for Future Expansion/Extension Projects, shall not
be eligible for a right-of-first-refusal unless Mojave and
Shipper agree to a conditional contractual right-of-first-
refusal that would take effect upon a determination that the
proposed project will not go forward. Capacity that is sold
on an interim basis pursuant to Section 9.3, Prospective Sale
of Available Capacity, shall not be eligible for a right-of-
first-refusal. Capacity offered pursuant to Section 38.1
will be limited to the extension rights of the off-system
capacity.
(a) Shipper(s) desiring to acquire such available
capacity shall notify Mojave, via its electronic
bulletin board, during the open season. Such
bidding shall be conducted in conformance with the
requirements of Section 34.2 of the General Terms
and Conditions of this Tariff.
(b) Shipper's bid must include:
(i) Shipper's legal name, DUNS number and, if
applicable, the contract number under
which it desires to acquire capacity;
(ii) the quantity of capacity to be acquired
at each receipt and delivery point;
(iii) the term of the acquisition; and
(iv) the maximum rate Shipper is willing to
pay for the capacity.
(c) The potential Shipper must satisfy the other
provisions of this Tariff applicable to requests
for firm transportation.
