32. NON-CONFORMING AGREEMENTS (continued)

1. National Energy & Trade, LP, Firm Gas Transportation Agreement - FT-C, dated

November 26, 2008, Billing Commencement date shall be the first date gas can be

nominated, scheduled and transported south from the interconnect pursuant to Rate

Schedule FT-C. Contract No. FC0002.

2. United Energy Trading LLC, Firm Gas Transportation Agreement - FT-C, dated

January 20, 2009, Billing Commencement Date shall be the first date gas can be

nominated, scheduled and transported south from the interconnect pursuant to Rate

Schedule FT-C. Contract No. FC0003.

3. Tenaska Marketing Ventures, Firm Gas Transportation - FT-A, dated February 5,

2009, Billing Commencement Date shall be the in-service date of the Scotland-REX

interconnect which is the first date gas can be nominated and scheduled through

the Scotland-Rex facility on both REX and Midwestern. Contract No. FA0879.

4. Northern Indiana Public Service Company, Firm Gas Transportation - FT-A, dated

February 20, 2009, Billing Commencement Date shall be the in-service date of the

Scotland-REX interconnect. Contract No. FA0880.

5. Spark Energy Gas, LP, Firm Gas Transportation - FT-A, dated February 20, 2009,

Billing Commencement Date shall be the in-service date of the Scotland-REX

interconnect. Contract No. FA0881.

6. CIMA Energy Ltd., Inc., Firm Gas Transportation Agreement - FT-C, dated February

3, 2009, Billing Commencement Date shall be the first date gas can be nominated,

scheduled and transported south from the interconnect pursuant to Rate Schedule

FT-C. Contract No. FC0005.

7. Roanoke Gas Company, Firm Gas Transportation Agreement - FT-A, dated June 16,

1998, effective October 1, 1998. Contract No. FA0016.

8. City of Morgantown, Firm Gas Transportation Agreement - FT-A, dated October 1,

1998, effective October 1, 1998. Contract No. FA0019.
