1.3 If so elected by Customer, Pipeline may act as Agent in order to purchase gas

available for no-notice service at the Customer's Point(s) of Receipt.

1.4 To the extent permitted by Pipeline's FERC Gas Tariff, Fifth Revised Volume No. 1

(hereinafter the "Tariff"), and FERC orders and regulations, Pipeline shall have the right

to interrupt service under this Agreement if at any time Customer fails to materially

comply with any provision of this Agreement.
