6.4 (a) Should a Customer desire waiver of the capacity curtailment provisions of
Paragraph 6.3(a) during emergency situations in order to prevent injury to life or property
or to provide minimum plant protection, Pipeline shall retain the right but not the obligation
or duty to provide for an exception in all or part to its curtailment provisions set forth
herein.
(b) The Customer seeking waiver shall inform Pipeline and Pipeline shall inform all
affected Customers as to the extent of the situation or emergency giving rise to the
necessity for an exception to the curtailment provisions of this Section 6 and the
measures that have been taken to reduce the extent of the situation or emergency.
(c) A Customer whose Gas was diverted under this Paragraph 6.4 shall have the option
to be compensated for such Gas by the Customer whose request for emergency relief
resulted in a loss of transportation capacity or the need for Pipeline to divert Gas either
through the delivery of quantities of Gas equal to the quantities of
