(iv) Intraday 1 Recall Notifications:
(a) A Releasing Shipper recalling capacity should provide
notice of such recall to the Transporter and the first
Replacement Shipper no later than 7:00 a.m. on the day
that Intraday 1 Nominations are due;
(b) The Transporter should provide notification of such
recall to all affected Replacement Shippers no later
than 8:00 a.m. on the day that Intraday 1 Nominations
are due (Central Clock Time); and
(v) Intraday 2 Recall Notifications:
(a) A Releasing Shipper recalling capacity should provide
notice of such recall to the Transporter and the first
Replacement Shipper no later than 2:30 p.m. on the day
that Intraday 2 Nominations are due;
(b) The Transporter should provide notification of such
recall to all affected Replacement Shippers no later
than 3:30 p.m. on the day that Intraday 2 Nominations
are due (Central Clock Time).
In the event of an intra-day capacity recall, Transporter
will determine the allocation of capacity between the
Releasing Shipper and the Replacement Shipper(s) based upon
the Elapsed Prorata Capacity. Variations to the use of
Elapsed Prorata Capacity may be necessary to reflect the
nature of Transporter's Tariff, services, and/or operational
characteristics.
Transporter will not be obligated to deliver in excess of
the total daily contract quantity of the release as a result
of NAESB WGQ Standard No. 5.3.55.
The amount of capacity allocated to the Replacement
Shipper(s) should equal the original released capacity less
the recalled capacity that is adjusted based upon the Elapsed
Prorata Capacity or other Transporter Tariff specific
variations of the Elapsed Prorata Capacity in accordance with
NAESB WGQ Standard No. 5.3.56.
For recall notification provided to the Transporter prior
to the recall notification deadline specified above and
received between 7:00 a.m. and 5:00 p.m., the Transporter
should provide notification to all affected Replacement
Shippers no later than one hour after receipt of such
recall notification. For recall notification provided to
the Transporter after 5:00 p.m. and prior to 7:00 a.m., the
Transporter should provide notification to all affected
Replacement Shippers no later than 8:00 a.m. after receipt
of such recall notification (Central Clock Time).
The Releasing Shipper shall make such recall effective
by communicating the recall via GEMStm and submitting a
nomination change to Transporter, pursuant to Section
6.1 of these General Terms and Conditions.
