1/ This agreement does not deviate in any material aspect from the Tariff.
2/ The rates are inclusive of Dakota and GSR surcharges, but exclusive of the ACA Surcharge.
3/For Shipper's or any Replacement Shipper's use of any Secondary Receipt Points (or any combination of Primary and Secondary Receipt Points)
within the Joliet Hub, the above rates shall be charged for that portion of capacity used for such purposes. For Shipper's or any
Replacement Shipper's use of any Secondary Delivery Points (or any combination of Primary or Secondary Delivery Points) in the State of
Wisconsin and/or along ANR's Menominee Lateral, the above rate shall be charged for that portion of capacity used for such purposes.
4/Shipper or any Replacement Shipper shall be charged a Reservation Charge equivalent to a daily rate of $0.14 per Dth/day for receipts at any
Secondary Receipt Points (or any combination of Primary and Secondary Receipt Points) outside the Joliet Hub but within Transporter's ML-7
Zone, and to any Secondary Delivery Points either outside the State of Wisconsin or along Transporter's Menominee Lateral, but within the ML-
7 Zone. Commodity Charges for such uses shall be at the above rates.
5/Transporter's effective maximum tariff rates shall be charged on a daily basis to Shipper or any Replacement Shipper(s) for that quantity of
service delivered or received at Secondary Receipt or Secondary Delivery Point(s) outside Transporter's ML-7 Zone.
6/With the exception of Government imposed surcharges, for any surcharge placed in effect after November 5, 1999, the monthly reservation rate
will be adjusted to eliminate any impact such that Transporter remains revenue neutral. Revenue neutral means that, for the applicable
month, taking into account Shipper's exercise of its entitlements, and permanent assignments undertaken, the total amount paid to Transporter
in that month is the same as would have been paid to Transporter for services actually provided under all of the agreements in Shipper's
portfolio as of April 1, 2000.
