17. NOTICES

Except when the terms of this Tariff require or allow for

communication via 1LineSM or EDM, any communication, notice,

request, demand, statement, or bill provided for in the Tariff or

in an Agreement or OBA, or any notice which either Transporter or

Shipper may desire to give to the other, shall be in writing and

shall be considered as duly presented, rendered, or delivered

when mailed by either post-paid registered or ordinary mail or

when sent by telegram, cable, telecopy, telex, express mail

service, or such other method mutually agreed upon between the

parties. The material so sent shall be addressed to the pertinent

party at its last known post office address, or at such other

address as either party may designate.

18. MODIFICATION

No modification of the terms and provisions of an Agreement shall

be made except by the execution of written contracts.

19. WAIVER

19.1 Transporter may waive any of its rights or any obligations

of Shipper hereunder as to any specific right or obligation

that has already arisen or in advance as to any specific,

temporary issue on a case-by-case basis that is not unduly

discriminatory.

19.2 No waiver by either Transporter or Shipper of any one or

more defaults by the other in the performance of any

provisions of the Agreement shall operate or be construed as

a waiver of any future default or defaults, whether of a

like or of a different character.
