RATE SCHEDULE ITS

Interruptible Transportion Service

1. AVAILABILITY

(a) This open access rate schedule is available for the transportation

(and a gathering service, if applicable) by Kentucky West Virginia

Gas Company (hereinafter called "Pipeline") of natural gas on an

interruptible basis on behalf of any Shipper (hereinafter called

"Customer") where Customer has an executed service agreement in

the form provided in this Tariff with Pipeline providing for such

service. Service under this Rate Schedule shall be provided

subject to the provisions of Subparts B or G of Part 284 of the

Commission's regulations.

(b) The following reasonable limitations shall apply to the

availability of service under this rate schedule:

(1) Pipeline shall not be required to agree to provide any

requested transportation service for which capacity is not

available or that would require the construction or

acquisition of any new facilities; and

(2) Pipeline shall agree to provide requested transportation

service hereunder on a "first-come, first-served" basis, as

among requests for interruptible service.

2. APPLICABILITY AND CHARACTER OF SERVICE

Transportation service hereunder shall consist of the acceptance by

Pipeline of natural gas tendered by or on behalf of Customer

for transportation at the Receipt Point(s) specified in the executed

Service Agreement, the transportation of that natural gas through

Pipeline's system, and the delivery of that gas, after retainage at

the level provided for in the Currently Effective Rates, Sheet No. 5

of this Tariff, by Pipeline to Customer for Customer's account, or

to the system of a third-party, at the Delivery Point(s) in the

executed Service Agreement.

3. RATE

Customer shall pay Pipeline for service, including gathering service if

applicable, rendered hereunder during each monthly billing period an

amount equal to the volume of gas transported by Pipeline for Customer

during the billing period multiplied by the Total Commodity Charge

specified in the Currently Effective Rates, Sheet Nos. 4 and 5 of

this Tariff, plus applicable GRI charge and ACA funding charge as

set out in Sections 28 and 29, respectively, of the General Terms

and Conditions.
