8. RECOVERY OF NATURAL GAS POLICY ACT PRICES

This Rate Schedule is subject to Section 34 of the General Terms and

Conditions and to the provisions of Volume 3 of Kentucky West's FERC

Gas Tariff, which sets forth the settlement agreements with the former

Rate Schedule GSS-1 customers identified therein arising out of Public

Service Comm'n of New York v. FERC, 463 U.S. 319 (1983) and Kentucky

West Virginia Gas Co. v. FERC, 780 F.2d 1231 (5th Cir. 1986).
