14.11 LIMITS OF RESPONSIBILITY

Horizon shall not be responsible for an omission or

failure by Horizon to act or perform any duty requested by a

function accessed via DART if such omission or failure to act is

caused by or related to data lost in the transmission of such data

from Subscriber's to Horizon's computer system, power failures,

failure of backup systems, or any other event beyond the

reasonable control of Horizon.

14.12 RESERVATION

Horizon reserves the right to add, modify or terminate

DART functions at any time subject to compliance with Commission

Regulations.

14.13 AGREEMENT

Any Subscriber who is not a Shipper will be required

to sign an agreement with Horizon pursuant to which the Subscriber

agrees to be bound by the provisions of this Section.
