charge unit rate for a particular fiscal year prohibits

Transporter from making a timely filing, whereupon the

FERC's notice requirements under 18 C.F.R. 154.22 shall

be deemed waived for purposes of this Article 17.

The proposed effective date of filings pursuant to this

Subsection shall be the effective date prescribed by the

Federal Energy Regulatory Commission. Such filing shall

become effective without suspension or refund obliga-

tion.

17.5 Payment by Shipper

The amount of ACA charges applicable to each Shipper

shall be due and payable with the bill for the month of

each such Shipper.
