to any other remedy it may have hereunder, may, without damage,
suspend further delivery of gas until such amount is paid or
terminate service pursuant to the terms and conditions of the
Service Agreement under which service is being provided.
If Shipper has notified Transporter in writing of an error in
invoice under subsection (c) and during the period for which a
genuine dispute exists as to the alleged error, Shipper shall pay
the portion of the invoiced amount which is not in dispute and shall
provide documentation identifying the basis for the dispute.
f. Suspension or Termination of Service. In the event Shipper fails to
pay the amount of any invoice tendered for charges made under or
pursuant to any of the provisions of this FERC Gas Tariff within ten
(10) days after the date such invoice is due under subsection (d)
above, Transporter may suspend or terminate service to Shipper under
the following conditions:
(1) Transporter shall notify Shipper of noncompliance and will
allow Shipper twenty (20) days from the date notice is
postmarked to correct the noncompliance and provide
adequate assurances that such noncompliance will not recur.
(2) In the event Shipper fails to correct the noncompliance and
provide assurances acceptable to Transporter and its
creditor within twenty (20) days of notice, including, but
not limited to, letters of credit, Transporter may suspend,
or, if consistent with the terms of the Service Agreement
between Shipper and Transporter, terminate service after
expiration of the twenty (20)-day period specified above.
Transporter shall offer any firm capacity rights terminated
pursuant to this provision in accordance with Section 21B.
Transporter shall notify Shipper and the Commission in
writing of its decision to suspend or terminate service.
g. Statement of Account. Transporter shall provide Shipper with a
detailed Statement of Account in accordance with the NAESB
Standards, which statement shall indicate any outstanding amounts by
invoice.
