AGS SERVICE AGREEMENT

APPLICABLE TO APPALACHIAN GATHERING

SERVICE UNDER RATE SCHEDULE AGS

 

 

THIS AGREEMENT is made and entered into this _____ day of_______,

20___, by and between Equitrans, L.P., (hereinafter called "Equitrans") and

_____________________, (hereinafter called "Customer").

 

IN CONSIDERATION of the mutual covenants herein contained and other

good and valuable consideration, the parties hereto agree as follow:

 

ARTICLE I

Service to be Rendered

 

1.1 Equitrans shall perform and Customer shall receive service

in accordance with the provisions of the effective AGS Rate Schedule and

applicable General Terms and Conditions of Equitrans' FERC Gas Tariff,

on file with the Federal Energy Regulatory Commission ("Commission"),

as the same may be amended or superseded in accordance with the rules and

regulations of the Commission. The maximum obligation of Equitrans, to

receive gas at multiple Appalachian receipt points and deliver such quantities

into the Gathering Aggregation Points maintained by the Customer on an

interruptible basis, is specified in Appendix A, as the same may be amended

from time to time by agreement between Equitrans and the Customer, or in

accordance with the rules and regulations of the Commission.

 

ARTICLE II

Term

 

2.1 This Agreement shall become effective pursuant to Section 4 of

Exhibit A.

 

 

ARTICLE III

Rates

 

3.1 Customer shall pay Equitrans any charges and furnish any

retainage as may be described in the above-referenced Rate Schedule, unless

otherwise agreed to by the parties in writing and specified as an amendment to

this Service Agreement.
