three (3) months from the date the claim is made. Such time limits

shall not apply in the case of deliberate omission or

misrepresentation, or mutual mistake of fact, nor shall this

provision diminish other statutory or contractual rights of the

parties.

2.8 Preservation of Records - Both Equitrans and Shipper shall preserve

for a period of at least five (5) years or such other period as may

be required by public authority, all test data, charts and other

similar records pertaining to measurement of gas hereunder.
