3.3 Delivery Specifications (Continued)
(f) Diluents - The gas shall not at any time contain in excess of
four percent (4%) total diluents (the total combined carbon
dioxide, nitrogen, helium, oxygen, and any other diluent
compound) by volume.
(g) Dust, Gums and Solid Matter - The gas shall be commercially
free from solid matter, dust, gums, and gum forming
constituents, or any other substance which interferes with the
intended purpose or merchantability of the gas, or causes
interference with the proper and safe operation of the lines,
meters, regulators, or other appliances through which it may
flow.
(h) Heating Value - The gas shall have a Heating Value of not less
than 967 Btu per cubic foot. For Natural Gas delivered at the
border between the States of Arizona and California, the gas
shall have a Heating Value of not less than 995 Btu per cubic
foot.
(i) Temperature - The gas shall be delivered at temperatures not in
excess of one hundred twenty degrees Fahrenheit (120°F) nor
less than fifty degrees Fahrenheit (50°F) except during those
times when due to normal operating conditions and/or seasonal
ambient temperatures on or near the pipeline system the
temperature may drop below such lower limit.
(j) Deleterious Substances - The gas shall not contain any toxic or
hazardous substance, in concentrations which, in the normal use
of the gas, may be hazardous to health, injurious to pipeline
facilities or be a limit to merchantability.
(k) If, at any time, gas delivered by Transporter shall fail to
substantially conform to the specifications set forth in this
Section 3.3 (a) - (j) of the GT&C, Shipper or its designee
agrees to notify Transporter of such deficiency. Shipper, or
its designee, may agree to waive Transporter's compliance with
its delivery specifications or, if Transporter fails to
promptly remedy any such deficiency within a reasonable time,
then Shipper or its designee may, at its option, refuse to
accept delivery pending correction of the deficiency by
Transporter or continue to accept delivery and make such
changes as necessary to cause the gas to conform to such
specifications, in which event Transporter shall reimburse
Shipper or its designee for all reasonable expenses incurred by
Shipper or its designee in effecting such changes.
