Load Management (Market Area) Service
9.7 Notice of Swings: A Balancing Party shall use reasonable efforts
to give Transporter's Gas Control notice by telephone or by fax
when Balancing Party intends to swing by more than 10% of
Scheduled Quantities. Upon Transporter's request, Balancing Party
shall also provide Transporter's Gas Control with daily or monthly
non-binding injection/withdrawal schedules.
9.8 In order to provide the Storage Swing Option, Transporter has
executed with Tennessee a Delivery Point Balancing Agreement with
a Downstream Storage Swing Amendment in accordance with Section 9
of Tennessee's LMS-MA Rate Schedule. In the event that Tennessee
suspends the effectiveness of the Downstream Storage Swing
Amendment in accordance with Section 4 of that Amendment,
Transporter reserves the right to suspend the Storage Swing Option
effective upon 18 hours prior notice; provided, however, that
Transporter will use its reasonable efforts to provide Shippers
with as much advance notice as possible. For the duration of any
such suspension and through the end of the Month of the
suspension, all imbalances shall be resolved through the Cashout
Option. The Storage Swing Option will automatically become
effective again when the condition that necessitated the
suspension has ceased to exist unless the Balancing Party
exercising the Storage Swing Option chooses not to resume the
Storage Swing Option.
9.9 Upon one day prior notice, Transporter reserves the right to
terminate a Balancing Party's election of the Storage Swing Option
if Transporter has: (a) first provided Balancing Party with a
warning via fax that Balancing Party is exceeding its Storage
Swing Limit; and (b) after such warning, Balancing Party continues
to exceed its Storage Swing Limit.
9.10 Operational Integrity - Nothing in this Section 9 shall limit
Transporter's right to take action as may be required to adjust
deliveries of gas in order to alleviate conditions that threaten
the integrity of its system.
10. GENERAL TERMS AND CONDITIONS
10.1 Shipper shall provide Transporter with such information as is
needed to meet the requirements placed on Transporter by
regulation, rule, and/or order by any duly authorized agency.
Furthermore, any terms or conditions not specified in this Rate
Schedule shall be determined consistent with the General Terms and
Conditions of Transporter's FERC Gas Tariff, which are
incorporated into this Rate Schedule.
10.2 In the event of a conflict between the provisions of this Rate
Schedule and Transporter's General Terms and Conditions, the
provisions of Transporter's General Terms and Conditions shall
govern.
