FT-1 (DI) TRANSPORTATION SERVICE AGREEMENT
(For Use Under Rate Schedule FT-1 (DI))
THIS TRANSPORTATION SERVICE AGREEMENT ("Agreement") is made and
entered into as of the ________ day of ___________, 19___, by and
between Dauphin Island Gathering Partners, a Texas general partnership,
hereinafter referred to as "Transporter" and ___________________, a
_______________________, hereinafter referred to as "Shipper".
Transporter and Shipper shall collectively be referred to herein as the
"Parties".
ARTICLE I
DEFINITIONS
1.1 Maximum Daily Quantity or MDQ - shall mean the maximum
daily quantity of gas in Dth which Transporter agrees to
receive (excluding lost-and-unaccounted-for gas) and
transport on each Path specified on Exhibit "A" attached
hereto, on a firm basis, subject to Article II herein, for
the account of Shipper hereunder on each day during the
term hereof. Any limitations on the quantities to be
received from each Receipt Point or delivered to each
Delivery Point shall be as specified on Exhibit "A"
attached hereto.
1.2 The term equivalent quantity shall be as defined in Section
1 of the General Terms and Conditions of Transporter's FERC
Gas Tariff.
1.3 Path - shall mean the pathway between a Primary Receipt
Point and Primary Delivery Point through which gas is
transported under a Transportation Service Agreement. Gas
received at a Primary Receipt Point specified on Exhibit
"A" attached hereto, shall be delivered at the associated
Primary Delivery Point specified on Exhibit "A" attached
hereto.
ARTICLE II
TRANSPORTATION
Transporter agrees to accept and receive daily on a firm basis,
at the Primary Receipt Point(s) from Shipper or for Shipper's account
such quantity of gas as Shipper makes available up to the Maximum Daily
Quantity for each Path, and to deliver to or for the account of Shipper
to the Primary Delivery Point(s) an equivalent quantity of gas.
