remaining under the Releasing Shipper's
Transportation Service Agreement, unless
Transporter agrees otherwise in a nondiscriminatory
manner. Furthermore, the Acquiring Shipper must
contract for the Primary Receipt Point(s) and
Primary Delivery Point(s) specifically set forth in
a Releasing Shipper's Offer of firm capacity.
The Acquiring Shipper then has the right to release
its capacity on a permanent or temporary basis
under the terms and conditions of this Section 19.
Upon the successful completion of a Permanent
Release, the Releasing Shipper shall be responsible
only for those charges under its Transportation
Service Agreement incurred with respect to the
released capacity prior to the effective date of
the Permanent Release hereunder, as well as charges
it continues to incur for firm capacity not
released on a permanent basis.
(b) Temporary Release: A Releasing Shipper may release
all or part of its firm capacity under a
Transportation Service Agreement for a term less
than the remaining term of the Transportation
Service Agreement ("Temporary Release"), pursuant
to one of the following methods and the further
provision of this Section 19.
(i) Firm Temporary Release: A Releasing Shipper
may temporarily release capacity on a firm
basis for a specified term without a right of
recall, except as provided in Subsection
19.3(c). The minimum term for any Firm
Temporary Release shall be one contract day.
All Firm Temporary Releases exceeding one
contract day must be offered for a
consecutive number of days, but such release
can commence on any day during the month.
(ii) Temporary Release Subject to Recall: Subject
to the provisions of Section 19.4, a
Releasing Shipper may temporarily release
firm capacity subject to a right of recall by
the Releasing Shipper upon the occurrence of
the condition precedent specified in the
Releasing Shipper's Offer under Subsection
19.6(c). The minimum term for any Temporary
Release Subject to Recall shall be one
contract day. Any Temporary Release Subject
to Recall offered for more than one contract
day must be offered for a consecutive number
of days, but such release can commence on any
day during the month.
