compress such gas deliveries, or cause such gas
deliveries to be compressed, without prior written
permission and approval of Pipeline.
11D.4 Uneconomical And Low Volume Receipt And Delivery Points;
Impossibility Of Measurement.
A. If in Pipeline's judgment, it is uneconomical to
continue to operate a facility on which Receipt or
Delivery Points are located, Pipeline has the right to
remove such facilities from service upon receipt of
any necessary regulatory approvals.
B. If total deliveries of gas to Pipeline at a Receipt
Point fall below an average daily quantity of ten Dt
for any thirty days, or if total deliveries to
Customer at any Delivery Point fall below an average
daily quantity of five Dt for any thirty consecutive
days, Pipeline may remove such facilities from service
unless:
1. Customer at such Delivery Point, or Customer's
supplier(s) at such Receipt Point, agrees to
reimburse Pipeline for Pipeline's expenses
associated with the operation or maintenance of
such Receipt or Delivery Point; or
2. Customer at such Delivery Point, or Customer's
supplier(s) at such Receipt Point, agrees to
assume responsibility of the Receipt Point
measurement, subject to the provisions of a
measurement operation agreement between Customer
and Pipeline, as well as compliance with the
provisions of this Tariff regarding measurement.
C. If total deliveries of gas to Pipeline at a Receipt
Point fall below an average daily flow rate of 2,400
actual cubic feet, Pipeline may employ any reasonable
means of measuring such receipts, including estimates,
but Pipeline makes no representation or warranty as to
its ability to accurately measure receipts of such low
volumes.
