cost of such facilities prior to Pipeline
commencing or continuing service hereunder.
2. Pipeline shall not be required to verify the
accuracy of such equipment more frequently
than once every ninety days; and
3. The meter correction period shall not be
limited to the period established in GT&C Section
4.9, above.
E. For any Appalachian Receipt Point shared with other
Customers, Customer must provide or cause to be
provided a predetermined allocation, consistent
with the most current form as posted on Pipeline's
Electronic Bulletin Board.
11D.3 Pressure.
A. If the pressure of Customer's gas at a Receipt
Point is or becomes too high for the safe and
efficient operation of Pipeline's system in the
vicinity of the receipt point, Customer shall upon
Pipeline's written request and at Customer's sole
expense, regulate the pressure or control the flow
of gas to reduce such pressure and install, operate
and maintain necessary equipment and facilities to
protect Pipeline's system and connected wells and
other facilities from over-pressurization resulting
from any cause.
B. Customer shall operate his facilities in a
reasonable and prudent manner. Pipeline shall not
be responsible for, and Customer shall indemnify
and hold Pipeline harmless from, any damages or
liability for injury to, or death of persons or
damage to property of Pipeline or third persons
resulting from Customer's failure to install such
equipment or its failure to maintain and operate
properly such facilities, provided that Pipeline
will not be indemnified to the extent of its own
negligence, willful misconduct, or fraud in causing
such damage or liability.
C. Customer shall make deliveries to Pipeline against
the existing pressure in Pipeline's facilities.
Pipeline shall not be obligated to lower such line
pressure by compression or otherwise, and
