GENERAL TERMS AND CONDITIONS (Cont'd)

(b) EPCA Surcharge. In each Annual EPCA Filing, Transporter shall calculate, and allocate to the

applicable Rate Schedules or services covered by that particular EPCA Rate on an as-billed basis and in a manner

consistent with Transporter's currently effective cost allocation and rate design, the EPCA Surcharge by

subtracting from the Electric Power Costs actually incurred by Transporter during the preceding calendar year

the amount collected by Transporter during that period under the particular EPCA Rate and dividing the

difference, whether positive or negative, by the estimated design determinants under all of the applicable Rate

Schedules or services covered by that particular EPCA Rate for the 12-month period commencing on the effective

date of that Annual EPCA Filing. The following is an example of the calculation of an LNG EPCA Surcharge and

Transporter's most recent EPCA Filing through the date of termination (Termination Period) shall remain liable

for any unrecovered Electric Power Costs.
