(ii) Shipper shall have no more than 24 percent of MAC in
storage between and including May 1 and May 15 of each
year, unless Transporter determines, on a non-
discriminatory basis, that retention of a higher
quantity of Gas will not adversely affect Transporter's
storage reservoirs. In such instance, Transporter shall
specify the higher level Shipper may maintain.
(iii) Pursuant to the definition of Reservoir Integrity
Inventory Limit in Section 1 of the General Terms and
Conditions, Transporter shall evaluate its storage
reservoirs each year to determine if Shipper can be
authorized to maintain a higher inventory level in
storage during the following withdrawal and injection
seasons. Transporter shall base this evaluation on
actual storage usage during the previous year and shall
post the revised requirements (variable Reservoir
Integrity Inventory Limits) on its electronic bulletin
board on or before January 21 of each year.
(iv) The above requirements notwithstanding, 100 percent of
all quantities stored hereunder shall be withdrawn upon
expiration of the term of the Agreement.
(c) If, on any Day during the Withdrawal Period, Shipper requests
Transporter to withdraw and Deliver to Shipper a quantity of
Gas up to Shipper's ADWQ and Transporter fails to do so, then
Shipper's obligation to withdraw its Gas shall be extended by
the number of Days that Transporter failed to withdraw and
Deliver the quantity requested by Shipper. Any quantities
required to be withdrawn which have not been withdrawn as
provided hereunder shall become the property of Transporter
without charge and shall be free and clear of any adverse
claims.
