5. MEASURING EQUIPMENT
A. Installation and Operation.
Transporter shall install, maintain and operate, at its own expense, except as
provided in Section 32 (Construction of Facilities) of the General Terms and
Conditions, at or near each point of delivery, a meter or meters and other
necessary measuring equipment by which the volume of gas delivered to the
Shipper shall be measured.
B. Check Measuring Equipment.
A Shipper may install, maintain and operate such check measuring equipment as
it shall desire, provided that such equipment shall be so installed as not to
interfere with the operation of the Transporter's measuring equipment at or
near the point of delivery. Upon notice to Shipper, Transporter shall have
access to such check measuring equipment at all reasonable hours, but the
reading, calibrating and adjusting thereof and the changing of charts for such
check measuring equipment shall be done only by the Shipper.
C. Access to Equipment and Records.
Both the Transporter and the Shipper shall be notified and shall have the
right to be present at the time of any installing, reading, cleaning,
changing, repairing, inspecting, calibrating or adjusting done in connection
with the other's measuring equipment used in measuring deliveries hereunder.
The records from such measuring equipment shall remain the property of the
owner, who upon request will submit to the other such records and charts,
together with calculations there from, for the other's inspection and
verification, subject to return within ten (10) days after receipt thereof.
D. Care in Installation.
All installations of measuring equipment, applying to or affecting deliveries
of gas, shall be made in such manner as to permit an accurate determination of
the volume of gas delivered and ready verification of the accuracy of
measurement. Reasonable care shall be exercised by both the Transporter and
the Shipper in the installation, maintenance and operation of pressure
regulating equipment so as to avoid, so far as practicable, any inaccuracy in
the determination of the volume of gas delivered hereunder.
