32.8 UNILATERAL ACTION
In the event that the actions under Sections 32.4 through
32.7 are inadequate or there is insufficient time to carry out such
procedures, KMIP may periodically have to take unilateral action to
maintain System pressure and preserve the overall operational
integrity of KMIP's System (or any portion thereof). KMIP is
authorized to use all the resources of its system to such ends,
through the integrated operation of line pack and supply received into
KMIP's system, even though gas may be owned by a person other than the
entity receiving delivery. KMIP shall not, however, be responsible as
a supplier of gas to any Shipper.
32.9 APPLICABILITY OF ACTIONS
(a) In exercising its authority pursuant to Sections
32.4 through 32.8, KMIP shall generally direct its actions to Shippers
in the following sequence, to the extent such actions and/or
sequencing will tend to alleviate the situation to be addressed:
(1) First, to any Shipper which is causing
disruption due to its failure to maintain receipts and deliveries in
balance or to match physical flows with nominated receipts or
deliveries;
(2) Second, to any Shipper which is operating in a
manner which conflicts with sound operational practices in relation to
KMIP's System; and
(3) Lastly, to all other Shippers.
(b) Notwithstanding subsection (a), any Shipper which
has taken voluntary action to alleviate a situation shall be exempted
from further action hereunder to the extent of its voluntary action
until KMIP has applied equivalent measures to other Shippers.
(c) Operational Flow Orders shall require action within
any Shipper class proportionate to appropriate and relevant
parameters, such as applicable contract quantities or current or
recent flowing gas volumes.
