The amounts collected in excess of 100% of the highest daily

price, as applicable, net of costs, are subject to refund in

accordance with Section 37 of the General Terms and Conditions

of this Tariff. If Operational Flow Orders are in effect on

the date Shipper is required to comply with the notice, Shipper

shall be subject to the highest penalty charges set forth in

Section 37 of the General Terms and Conditions of this Tariff.

C. The tariff provisions of this Section 8.4 will be implemented

by Transporter on a non-discriminatory basis. In each instance

when an amount is collected pursuant to Section 8.4B due to

failure of Shipper to redeliver a loan balance, Transporter

shall have the right to review the circumstances surrounding

such failure to redeliver and, in its judgment, may waive all

or a portion of the amount collected in excess of 100% of the

highest daily price. Any such waiver shall be granted on a

non-discriminatory basis to all Shippers from whom amounts were

collected in that instance.

9. GENERAL TERMS AND CONDITIONS

The provisions of the General Terms and Conditions of this Tariff, as

such provisions may be amended from time-to-time, are hereby incorporated

by reference and made a part of this Rate Schedule. To the extent that

the General Terms and Conditions are inconsistent with the provisions of

this Rate Schedule, the provisions of this Rate Schedule shall govern.
