6/ Discounts or exemptions to the applicable FL&U percentages may only be

afforded under FERC policy, as it may exist from time-to-time.

Specific FL&U percentages may be developed, filed and included in this

Tariff to apply to specific transactions, consistent with FERC policy.

In such event, and absent provision otherwise, Transporter shall bear

the risk of any under-recovery of FL&U, consistent with the provisions

of Section 33 (Negotiated Rates) of the General Terms and Conditions of

this Tariff.
